US CFTC approves new rule to protect swaps customer funds

The US Commodity Futures Trading Commission by a 4-to-1 vote Wednesday approved a final rule on how futures commission merchants protect their customers' money, the latest in what is expected to be a long line of new rules on how customer funds are handled.

The rule applies only to swaps, not futures, and drew criticism from the CFTC's two Republican commissioners for doing little to prevent the mammoth loss of customer funds that followed MF Global's collapse in October.

Regulators are still investigating the whereabouts of potentially more than $1.2 billion missing from bankrupt MF Global's customer accounts.

Commissioner Scott O'Malia, a Republican, voted in favor or the rule, but said he did not want to give market participants "a misleading sense of comfort" that it would have prevented the loss of customer money at the brokerage giant.

"This rulemaking does not address MF Global," O'Malia said. "This rulemaking would not have prevented a shortfall in the customer funds of the ranchers and farmers that transact daily in the futures market. Nor would it have expedited the transfer of positions and collateral belonging to such customers in the event of a collapse similar to that of MF Global."

Commissioner Jill Sommers, the Republican and lone vote against the rule, criticized the rule for doing nothing to protect a futures commission merchant's futures customers.

"Given recent events, we need to re-think this approach so we can provide adequate protections, in a comprehensive and coherent way, to swaps customers and to futures customers," Sommers said. "I do not favor a piecemeal approach to customer protection."

"Risks remain," Wasserman said.

Wasserman said these new protections could become the basis of forthcoming rules on how futures customers funds are protected by FCMs.

The rule approved Wednesday would require FCMs to keep customer collateral in an account segregated from the FCM's own property. However, the rule allows FCMs to keep all of their swaps customers' collateral in a single account. The rule includes requirements in the case of bankruptcy and customer shortfalls and how that money will be transferred back to customers.

CFTC Chairman Gary Gensler said the rule "prohibits clearing organizations from using the collateral of non-defaulting, innocent customers to protect themselves and their clearing members."

"For the first time, customer money must be protected individually all the way to the clearinghouse," Gensler said.

Commissioner Mark Wetjen said that the rule will reduce the risk of customers losing money, but it does not eliminate it. Excess collateral in an FCM's customer account "is always exposed to operational risk, including risks of fraud or misappropriation."

Chilton also suggested an insurance fund for the derivatives market, similar to the Securities Investor Protection Corporation in the securities market, in the case of a bankruptcy.

New ShopRite to open in Toms River Wednesday

Late last week, the inside of ShopRite on Route 37 in Toms River was teeming with activity, preparing for a long-awaited unveiling.

Workers were filling the shelves with groceries. Frozen foods packed rows of freezer cases.

The new ShopRite, the 29th supermarket from Saker ShopRites Inc., opens Wednesday at 7 a.m. in what is essentially a new shopping center at the intersection of Route 37 and Route 166, just off the Garden State Parkway, a swatch of land that was once the old Dover Mall. A groundbreaking ceremony is being held at 11 a.m. Monday.

It’s a transformation of the shopping center, which has a new name to go along with its new look: Crossroads Center. Staples already has opened its new store there. Spirits Unlimited is expected to open sometime in December with Party Fair following at the beginning of 2012.

Now old buildings that were once a part of the Dover Mall are fenced off and await demolition. Most of the remaining land will become a parking lot.

“I am absolutely thrilled,’’ Toms River Mayor Thomas F. Kelaher said.

Fire sends toxins into the air

ALBUQUERQUE (KRQE) - A health advisory is in place as a scrap metal yard in the South Valley continues to burn.

Firefighters say this isn't the first time they've had to deal with the Albuquerque Metal Recycling Plant. Bernalillo County's Deputy Fire Chief says his crews are called to the plant at least once a year for fires.

They were able to contain the flames Tuesday afternoon, but the smoke will continue to drift from the piles of smoldering cars, refrigerators and other appliances.

"It's plastics and vinyl, paint and maybe tires,I have never solved a Rubik's magic cube ." said Jeff Stonesifer with the Albuquerque Air Quality Department. "No one knows exactly for sure what's burning."

Deputy Fire Chief Frank Barka explained some of the stacks look suspicious.Prior to Aion Kinah I leaned toward the former,

"I've heard one of the stacks, which we call the fluff stack, is not supposed to be that big," Barka said. "We are researching to see if he got a permit to keep it that high. If not,As many processors back away from offshore merchant account , he would be in violation of our fire code."

Barka added the environmental department will be called out to inspect the plant and see if anything toxic seeped into the ground. If the company is found at fault, they could be liable for the costs of extinguishing the flames.

The friend of Boutros who had the earlier confrontation with Gianis advised his friends not to make eye contact, but Boutros went up to Gianis, shook his hand and apologized for the earlier encounter.

When Boutros' friend held out his hand to do the same, Gianis said "Don't be so f¡­ing lippy" and sucker punched him, knocking him unconscious and causing a facial hairline fracture.

Boutros and another friend exchanged blows with Gianis. When Richard stepped in and challenged Boutros and his buddy to fight, Boutros broke a bottle and held it by its neck

"Drop the bottles. Fight like a man," Richard told Boutros, who was four feet away

Richard then pulled out his gun and fired at Boutros, who was hit in the stomach and liver before the bullet exited his body.

An RCMP officer on patrol in Whistler village heard the sound of breaking glass and then saw the shooting. He and his dog chased down the shooter.

At trial, a jury convicted Richard of second-degree murder.

B.C. Supreme Court Justice Christopher Hinkson, in sentencing Richard to life in prison with no parole for 16 years, said Richard had accepted a "violent and illegal lifestyle" and the sentence imposed was to deter similar gun-related crimes.

"The killing of Mr. Boutros was motiveless, impulsive and senseless," Hinkson said.

On appeal, Richard argued the trial judge erred in instructing the jury as to how to assess evidence and on the issue of self-defence.

A three-judge panel of the Appeal Court found no error by the trial judge, so unanimously dismissed Richard's appeal.

"True Blood" Enters Fairy Land

The Six Aromas You Don't Want to Smell in Your Wine

When you stick your nose in a glass of wine, what do you smell? Most of the time, the aroma will be fruity, floral or spicy. The wine may even be earthy or smell of smoked meats (as in a Northern Rhone Syrah), or buttery and tropical. All pleasant scents. But what if you smell rotten eggs, wet newspaper or a barnyard? More than likely that wine is flawed. And that's a wine you don't want to keep in your glass. If you're at home, dump it down the drain; at a bar or restaurant, send it back (more on this later).

One of wine's dirty little secrets is that there are bottles on the market that contained flawed, faulty juice. Some times a wine gets spoiled somewhere along the way in the winery, and some times it happens after bottling, during shipping or storage at a retail or restaurant location or even in your home. You know how wine is supposed to be stored at about 55F, in a dark space with low humidity and no vibration? This doesn't always happen.

I recently completed a course at the Culinary Institute of America in Napa Valley called "Sensory Analysis of Wine." The thing that made me want to take such a technical sounding course (which it wasn't) was learning how to identify flaws and faults in wine. I know many of the good aromas, but I didn't know the bad, or off aromas. It's possible I've sipped a few faulty wines but didn't know it and just thought the wine was funky. You've probably done that too, or perhaps you had a glass of wine you didn't like but couldn't say why. Most likely it was flawed.

We went through six common wine odor defects. Once you know them, you'll be able to smell them right away.

Oxidized -- The wine will smell like a sherry, and may smell stale, nutty or even like burnt marshmallow or stewed fruit. The wine's color can offer a clue too. Usually an oxidized wine will be turning a shade of brown -- brick red for reds, and golden to tawny for whites. An oxidized wine can mean it was subjected to hot temperatures, was not stored properly or was exposed to air. If you order a wine by the glass and it smells a little stale, ask how long the bottle has been open; it's probably been a few days. Not good. Keep in mind a newly opened bottle can also be oxidized.

Volatile Acidity -- Does that glass of wine smell like vinegar or remind you of nail polish remover or Easter egg dye? Volatile Acidity (also called VA) is the culprit, and it is a bacterial spoilage.

Sulfur -- I had a strong reaction to this glass, and it wasn't a good one. Stinky and offensive, hydrogen sulfide has the unmistakable scent of rotten eggs. While sulfur is used in winemaking to prevent microbes and bacteria, overuse or improper use can cause it to form hydrogen sulfide or dimethyl sulfide.Handmade oil paintings for sale at museum quality, (Not to be confused with sulfites.)

Brettanomyces -- For years I've heard the term "brett," and that some people love what it does to wine and others do not. But I didn't know what the heck it smelled like until this class. Think of cherry cough syrup, Band-aids, or smokey, barnyardy or horsey aromas. I'm told a sweaty horse blanket is a ringer for brett. Brettanomyces is a yeast spoilage. Old world wines may have a tiny amount of brett that some wine drinkers covet. You can also find brett in some Belgian Trappist beers

Cork Taint -- I know what a corked wine is. But I am still surprised at how many of my friends and family don't know it when it's stinking up their glass.We processes for both low-risk and high risk merchant account.
